1. Acceptance of Terms
By downloading, installing, or using Cielo ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
Cielo is a digital pilot logbook application that allows pilots to log flights, check weather, and visualize their flying history. The App is available for iOS devices.
3. User Accounts
To use certain features of the App, you may need to create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Providing accurate and complete information
4. Subscriptions and Payments
Cielo offers a free tier and a paid subscription (Cielo Pro).
- Free Tier: Allows logging up to 50 flight hours with basic features.
- Cielo Pro: Offers unlimited logging and additional features for a monthly or annual subscription fee.
All payments are processed through Apple's App Store. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your App Store account settings.
Prices may change with notice. Refunds are handled according to Apple's refund policies.
5. User Content and Data
You retain ownership of all flight data and content you enter into the App. By using the App, you grant us a limited license to store, process, and display your data solely for the purpose of providing the service to you.
You are responsible for the accuracy of the flight data you enter. The App is designed as a personal record-keeping tool and should not be solely relied upon for official or regulatory purposes.
6. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to the App or its systems
- Interfere with or disrupt the App's functionality
- Reverse engineer, decompile, or disassemble the App
- Share your account credentials with others
7. Intellectual Property
The App, including its design, features, and content (excluding user data), is owned by Cielo and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our permission.
8. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or completely secure.
Important: Cielo is a personal logbook tool. It is not intended to replace official flight records required by aviation authorities. Always maintain backup records as required by applicable regulations.
9. Limitation of Liability
To the maximum extent permitted by law, Cielo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill arising from your use of the App.
Our total liability for any claims arising from these Terms or your use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Cielo and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the App or violation of these Terms.
11. Termination
We may suspend or terminate your access to the App at any time for violation of these Terms or for any other reason. Upon termination, your right to use the App ceases immediately. You may export your data before termination.
12. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes through the App or by email. Continued use of the App after changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
